<Measures for the Implementation of Shanghai Municipal Food Business License and Record Management> was issued on 9th.Apr.2024. Here we highlight main parts for your reference. 

Scope of application: This measures shall apply for the city’s food business license application, acceptance, review, decision, and the recorder for sale pre-packaged food only (including health food, formula for special medical purposes, infant formula milk powder and other infant formula and other special foods, the same below) , as well as the related supervision and inspection work.

Scope of License: Engaged in food sales (including alcoholic commodities, wholesale and retail of hog products, beef and mutton products) and food service activities in the city, shall obtain a food business license in accordance with the law. 

The following situations do not require a food business license: 

(i) Sales of edible agricultural products (excluding hog products, beef and mutton products)
(ii) Sales of prepackaged food only (excluding alcoholic beverages)
(C) Medical institutions, drug retailers selling special medical use formulas in specific whole food formulas;
(D) Food producers who have obtained food production licenses to sell the food they produce in their production and processing sites or through the network;
(E) laws and regulations provide for other circumstances that do not require a food business license.

The one-local-per-license principle: 

(i) Food operators in different business premises to engage in food business activities, should be in accordance with the law, respectively, to obtain food business license or for the record. The place of business shall be within the scope of the residence of the food business operator’s main qualification documents set out.

(ii) Through the automatic equipment to engage in food business activities or only engaged in food business management activities, to obtain a business premises of the food business license or for the record, that is, can be carried out within the city has been licensed or filed within the scope of business activities.

This regulation shall become effective on May 10, 2024 and shall remain in effect until May 9, 2029.
